Stop the Sheriff’s Sale

If you have a Sheriff’s Sale scheduled for your home, it is not the end of the line. In New Jersey, every homeowner can ask the Sheriff’s office for two adjournments of the Sheriff’s Sale. Each adjournment delays the sale by 30 days. This gives you a potential 60 days to determine what your best option is moving forward, whether that be loan modification, bankruptcy, or any other methods to save your home. We can help you delay the Sheriff’s Sale and choose the next step from there.

Foreclosure Complaint

If the Sheriff’s office has served you with a Summons and Complaint in Foreclosure, there is no time to waste. You must file an answer within 35 days of receiving the Complaint in order to avoid a Default Judgment. Foreclosure Process

If you miss three mortgage payments or your account has been delinquent for over 120 days, your mortgage lender will begin the foreclosure process. First, you will receive a Notice of Intent to Foreclosure form that will give you at least thirty days to resolve the issue. If you are unable to work out a solution, you will receive a Summons and Complaint in Foreclosure, which you have 35 days to respond to. If you cannot resolve the issue, the court will side with the lender and schedule a Sheriff’s Sale of your house. At any point in this process, contact Dublin Packard to get the help you need. 

How Long Will It Take To Kick Me Out of My House?

In New Jersey, the timeline of the foreclosure process depends entirely on when things are responded to and how quickly they are sent out. At the least, you could have a Sheriff’s Sale ruled against you six months after missing your first mortgage payment. Once the Sheriff’s Sale is determined, it must be completed within the next five months – and it could happen the very next day.
